5. No user of this website will be allowed to carry out or facilitate any illegal or fraudulent business activity by utilizing this website and its online services.
6. The service providers involved in the website's business model, namely the professional (Freely registered), PMP and the PBSAs are individually responsible for the services that they may provide to their respective end clients. The website's management cannot be held responsible in any way in this regard.
7. Personal information asked in the Membership Application Form is solely for the purpose of disseminating information about the member's professional expertise in order to facilitate their marketing. No other intention lies beyond that. Therefore anybody unwilling to part with such information need not get associated with this website at all.
8. The website procures subscriptions or enrolment of PMPs through the PBSAs. The process soliciting for membership, agreeing to apply and completion of application formalities is entirely an exercise between the applicant and the PBSAs. Up to this point the website's management does not bear any responsibility. And after the completed application form along with all relevant papers and the requisite membership fee along with other add-ons like service tax, etc. are received by the website's management (Chartergain Management Services), its obligation towards the applicant comes into effect. The same process is applicable in case of applications made by prospective applicants for Microfranchisee through the Recruitment & Training Consultants.
9. The display of Professional and PMP profile is purely dependent on the online search based mechanism of the website. Therefore the display process is beyond manual control of the website's management. It disclaims any responsibility for any guaranteed display or number of viewings by visitors of any of its member profile during their membership tenure.
10. All listings of professionals, PMPs and PBSAs are self declared by them. If anything out of it is false and concocted the website's managements abjures any responsibilities for any damage or distress arising to anybody out of it.
11. No user allowed to copy the contents of the website's for use in any other medium of publication.
12. The website's management shall not be responsible or liable for any costs, charges and damaged of any nature what so ever incurred by a member (Paid or Freely registered ), a PBSA or any person claiming under them out of any act of commission or omission in rendering of services and/or in connection with the rendering of services by them.
13. The website's management will not act as party to any dispute of any kind between any of its members, Microfranchisee or between a PMP and a PBSA.
14. All notices required to given pursuant to the terms and conditions shall be in writing and shall be sent by registered post at the official address of Chartergain Management Services.
15. All disputes are subject to exclusive jurisdiction of New Delhi Courts.
16. Neither party shall be liable to the other in respect of anything which apart from this provision may constitute breach of terms and conditions arising by reason of forcemajeure, namely circumstances beyond the control of that party which shall include (but not limited to) an act of god, perils of the sea or fire, flood, draught, explosion, sabotage, accident, embargo, riot, civil commotion or unrest including acts of local government or parliamentary authority, breakdown of equipment, suspension of Licence and labour dispute of whatever nature, inability to procure materials and equipments required to provide the services and other circumstances resulting in inability to provide the services for whatsoever cause.
17. The website's management reserves the right to alter the membership fee, Microfranchisee fee, prices of Value Added Services or any other tariff related to it and also the terms and conditions without prior notice.
18. The validity of membership shall be governed by the validity of term mention in the membership packages schedule. However the website's management will have sole discretion to decide the display tenure of freely registered professionals.
19. The website's management reserves the right to accept or reject enrolment application for PMP membership and PBSA Microfranchisee and also terminated the same without assigning any reason.
20. The 'Stamp of Testimony' and 'Seal of Verification' are mere branding instruments and should not be construed as efficiency certificates. The website's management disclaims any responsibility for any confusion or misunderstanding or damaged as a result of it.
21. The Provisional retention and requisition service is not guaranteed service. It is based on receipt of enquiries from the 'Place a Requirement Box' which are unable to be referred and subject to availability of referable PMPs.
